KDP illegalities moved from parliament to Justice Ministry

The Kurdistan Democratic Party (KDP) transferred the illegal activity from the parliament to the Ministry of Justice with the Independent High Elections and Referendum Commission's reactivation announcement in the Waqai newspaper of the Kurdistan Regional Government (KRG). The Chairman of the Patriotic Union of Kurdistan (PUK) faction declared that "the PUK will not comply with the IHERC's reactivation."

The Justice Ministry broke the law

Ziad Jabar, the Chairman of the PUK faction, told PUKMEDIA: "The publication of any information about the commission's reactivation in the daily Waqai' is once again illegal because there is no legal, constitutional, or regulatory decision in support of it."

"Because the entire procedure was unlawful, the PUK will not comply with the commission's reactivation; we are not going to undertake any unlawful actions," Jabar declared.

The Justice Ministry is involved in the violations

The KDP, acting through the Ministry of Justice, broke the law regarding the reactivation of the commission and published the illegal act ahead of other laws, even though several laws passed by the parliament are awaiting publication in the newspaper Waqai'.

Luqman Wardi, the PUK faction's Deputy Chairman, informed PUKMEDIA: "The illegal disclosure of the commission's reactivation in the newspaper Waqai' is another unlawful act committed by the KDP via the Minister of Justice. The newspaper has not yet published several laws passed by parliament."

"The Labor Law and the Education Law are two significant laws for the Kurdistan Region, and although they have been passed in the Kurdistan Parliament for more than two months, the newspaper has yet to publish them," Wardi added.

Waqai has published an illegal decision

The issue of reactivating the commission began and ended in a way that was against the law, so it is also against the law to publish this in the newspaper.

Abbas Fatah, Deputy Chairman of the Kurdistan Parliament's Legal Affairs Committee, told PUKMEDIA: "Putting the issue of reactivating the commission on the agenda of the parliamentary session, the parliamentary session on it, and making a decision about it, and then publishing it in the newspaper Waqai'. All of these things were illegal, and there is no such thing as reactivating the commission."
 
"The KDP broke the law with its own group and the so-called leaders of the minorities. It has also led the Minister of Justice and his ministry to break the law and be controlled by party orders, even though the Minister of Justice, Firsat Ahmed, has been the secretary of parliament for three terms and is very familiar with the rules. But it is unknown why he made such a huge legal mistake," said Fatah.

"The KDP does not want to reactivate the commission so that elections can be held on time. "Rather, it wants to keep the parties apart because it knows that the farther the parties are from each other, the less likely it is that elections will be held," he added.

The newspaper of Waqai

The newspaper belongs to the KRG's Ministry of Justice. It is where all laws, decrees, and orders issued by the Kurdistan Parliament and the KRG are supposed to be published to be legitimately implemented. However, at the moment, the newspaper is entirely controlled by a party and is being made illegal on the party's orders.

The PUK has long supported the rule of law in the Kurdistan Region and throughout Iraq, enduring numerous sacrifices. By holding elections, the PUK intends to give the Kurdistan Region a new legal appearance and exhibit to the world the Region's legal and democratic side, following in the footsteps of the late President Mam Jalal, who was always concerned about enacting the law.
