The Iraqi Supreme Court dismissed Cardinal Mar Louis Sako's case challenging the issuance of Presidential Decree No. 31, ruling that the protocol followed in issuing the decree was appropriate.
According to the Federal Supreme Court's official website, "the Federal Supreme Court considered the lawsuit No. 186/Federal/2022, which includes challenging the validity of the procedures for withdrawing the presidential decree appointing Cardinal Mar Louis Raphael I Sako, Patriarch of Babylon."
"The Federal Supreme Court dismissed the plaintiff's lawsuit, Cardinal Mar Louis Raphael I Sako, Patriarch of Babylon, against the Chaldeans in Iraq and around the world, for lack of prejudice to the validity of the procedures for issuing Presidential Decree No. 31 of 2023, published in the Iraqi Gazette No. 4727 dated 3/7/2023 and including the withdrawal of Presidential Decree No. 147 of 2013."
In this regard, Iraqi President Dr. Abdullatif Jamal Rashid stated: "The abolition of the Presidential Decree is solely intended to correct a legal and constitutional void, as there is no legal, constitutional, or civil basis for Decree No. 147 of 2013."
"His Eminence, Cardinal Raphael Louis Sako, Patriarch of the Chaldean Church throughout the world, as well as Head of the Catholic community in Iraq," he added, "is highly valued by the Presidency of the Republic."
